Ontario has tightened eligibility rules for its publicly funded social assistance programmes, barring people living in Canada illegally as well as those staying in the country on temporary visas from receiving benefits. The move, announced by the provincial government, will affect categories including international students, temporary workers and visitors, and has been justified as an effort to ensure taxpayer-funded assistance is directed towards people legally entitled to receive it.
The changes were announced by Ontario Minister of Children, Community and Social Services Michael Parsa and have taken effect immediately. Under the revised regulations, people who are not legally authorised to remain in Canada, along with individuals whose immigration status permits only temporary residence, will no longer qualify for assistance through Ontario Works (OW) or the Ontario Disability Support Program (ODSP). The temporary category includes people holding study permits, work permits and those visiting Canada as tourists or visitors.
The provincial government said the changes are aimed at strengthening the eligibility framework for social assistance and protecting public funds. It maintained that Ontario’s welfare programmes are intended for individuals and families facing financial hardship who meet the province’s legal eligibility requirements.
Parsa said the government would continue supporting people who genuinely require assistance but argued that taxpayer-funded programmes should not be extended to individuals who are not legally eligible to receive them. According to the province, the revised rules provide greater clarity over who can access Ontario Works and ODSP and ensure that government assistance remains focused on its intended beneficiaries.
The decision follows a controversy surrounding a case in which an individual who had been living in Canada without legal status for many years was allowed to receive Ontario Works benefits. According to reports, the person had originally entered Canada on a temporary work permit in 1997 but subsequently lost legal status and remained in the country. A tribunal had ruled that the legislation then in force did not automatically exclude the individual from receiving benefits because the restrictions applied to specific categories, including visitors, tourists and people facing deportation or an enforceable removal order.
The case prompted Ontario Premier Doug Ford to signal that his government would amend the regulations if necessary to make the province’s position clear. Ford had said that while the government would continue to assist people facing genuine hardship, such support should not extend to people living in Canada illegally. The latest regulatory changes follow through on that position and go beyond undocumented residents by explicitly covering people whose permission to remain in Canada is temporary.
The move comes amid a broader debate in Canada over immigration levels, temporary residents and pressure on public services. Ontario, Canada’s most populous province, has been seeking tighter controls over access to publicly funded programmes as governments across the country reassess policies related to temporary immigration and the costs associated with supporting newcomers.
The revised rules mean that people who are in Ontario on student or work permits, despite having lawful temporary status, will not be eligible for the provincial social assistance programmes covered by the new regulations. The change therefore distinguishes between being legally present in Canada and having a status that makes an individual eligible for provincial income-support programmes.
The government has stressed that the changes concern eligibility for social assistance and do not, by themselves, alter the immigration status of people in Canada. Those affected by the new rules will continue to be governed by the conditions attached to their respective visas or permits.
Ontario’s decision is also significant for the large international student and temporary worker population in the province, many of whom rely on temporary immigration pathways while studying or working in Canada. The new rules make clear that temporary legal residence alone will not qualify an individual for Ontario Works or ODSP.
Officials have presented the changes as a measure to protect the integrity of the welfare system and ensure that limited public resources are reserved for those who meet the province’s eligibility criteria. The regulations now provide explicit exclusions for people without legal status and those authorised to remain in Canada only temporarily.
