Canada’s refugee and immigration policies have come under renewed scrutiny following allegations by advocacy groups that asylum seekers arriving at the country’s borders are being forced back into the United States, where they risk detention and deportation.
The concerns have been highlighted through a legal challenge launched by the Canadian Council for Refugees, Amnesty International Canada and a Honduran family, who argue that Canada is failing to provide adequate safeguards for vulnerable migrants under the Safe Third Country Agreement (STCA), a bilateral arrangement between Canada and the United States.
At the centre of the case is the story of a Honduran couple and their young son who fled their home country in 2021 to escape gang violence. After a perilous journey through Central America and Mexico, the family sought protection in North America. However, their plans to seek asylum in the United States were disrupted amid increasingly restrictive immigration measures and fears of detention and deportation.
The family subsequently attempted to enter Canada through a legal border crossing, hoping to reunite with relatives already living there. According to court documents cited by refugee advocates, Canadian border authorities informed the family that only the father and child qualified for an exemption under existing rules because of family ties in Canada. The mother, lacking similar connections, would be returned to the United States. Faced with the prospect of separation, the family chose to remain together and was sent back to the US before eventually being deported to Honduras.
Advocacy organisations contend that such cases expose serious shortcomings in the Safe Third Country Agreement, which requires asylum seekers to make refugee claims in the first safe country they enter. Introduced in 2004, the agreement effectively prevents many migrants arriving from the United States from seeking asylum at official Canadian land border crossings.
Critics argue that the United States can no longer be considered a safe destination for all asylum seekers, citing concerns over immigration detention practices and the possibility of deportation to countries where individuals may face persecution, violence or even death. They also claim that humanitarian exemptions built into the agreement are rarely applied in practice and that asylum seekers are often not adequately informed about their rights or opportunities to seek special consideration.
The controversy comes at a time when Canada is tightening its own refugee system. Recent legislative changes have introduced additional restrictions on refugee eligibility, prompting some groups to accuse the government of adopting increasingly hardline immigration measures.
Canada’s Supreme Court upheld the constitutionality of the Safe Third Country Agreement in 2023, noting that provisions allowing exemptions on humanitarian grounds helped ensure compliance with principles of justice. However, refugee advocates maintain that these protections are largely ineffective in real-world situations.
Canadian authorities have defended the agreement, stating that border officers possess limited discretion to delay removals in exceptional circumstances and that the United States continues to meet the legal requirements necessary to remain designated as a safe third country. The federal government has also stressed that allegations raised in the latest legal challenge have yet to be tested in court.
For the Honduran family, now reportedly living in hiding due to fears of retaliation from the gang they fled, the legal battle represents more than a policy dispute. Advocates say the case underscores the human consequences of immigration decisions and raises broader questions about whether existing refugee protections are sufficient for people seeking safety across North America.
