The United Kingdom has introduced changes to its immigration rules aimed at protecting skilled migrant workers who face exploitation or abuse at the hands of their employers. Under the new provisions announced by the UK Home Office, eligible Skilled Worker visa holders who are formally recognised as victims of modern slavery will be allowed to leave abusive employers and take up work with another employer without losing their existing immigration status.
The change is significant for migrant workers because the UK’s Skilled Worker visa system is generally linked to a specific sponsored job. Under the earlier arrangement, workers who left their sponsoring employer could face serious immigration consequences if they were unable to quickly secure another approved sponsor. This dependence on a particular employer has been criticised for creating opportunities for exploitation, particularly in sectors that rely heavily on overseas workers.
The revised rules create an exception for workers who are officially identified as victims of modern slavery by the relevant Home Office authorities. Once a worker receives a positive “conclusive grounds” decision through the UK’s National Referral Mechanism, the restriction preventing them from taking other employment will be lifted. They will then be permitted to work for another employer in any occupation for the remaining period of their existing immigration permission.
The protection is expected to be particularly relevant to workers in sectors such as social care, hospitality and other occupations that have historically employed large numbers of overseas workers. Care workers and chefs have been among those highlighted in reports about exploitation under the sponsored-work system. Concerns raised by campaigners have included underpayment, excessive working hours and arrangements that leave migrant employees particularly dependent on their sponsors.
For Indian migrants, the development could be especially important because thousands of Indians work in the UK under sponsored employment arrangements, including in healthcare, social care, hospitality and other skilled professions. However, the new provision does not mean that every Skilled Worker visa holder who is unhappy with their employer or chooses to resign can automatically change jobs without immigration consequences. The crucial requirement is formal recognition as a victim of modern slavery through the UK’s established assessment process.
The National Referral Mechanism is the UK’s system for identifying and supporting potential victims of modern slavery and human trafficking. The Home Office’s latest statistics show that 23,411 potential victims were referred through the mechanism in 2025, the highest annual number since the system began operating. Modern slavery includes offences involving human trafficking, slavery, servitude and forced labour.
The government said the immigration change is intended to prevent abusive employers from using a worker’s immigration status as a tool of control. The official explanation accompanying the new rules says the measure is designed to encourage victims to come forward and reduce the possibility of employers exploiting the sponsorship system. The government has also indicated that cases involving evidence of criminal conduct can be referred to the police.
The move comes amid wider efforts by the UK government to tighten oversight of employers sponsoring overseas workers. More than 6,600 sponsorship licences have reportedly been revoked since the Labour government came to power, including more than 4,400 during the year to June 2026. At the same time, the number of Skilled Worker visas granted has fallen sharply, with around 111,000 visas issued in the latest year cited by the report, substantially below the peak recorded in 2023.
The latest changes form part of a broader set of amendments to the UK Immigration Rules presented to Parliament on September 3, 2026. Besides provisions supporting victims of modern slavery, the changes cover areas including protection for victims of domestic abuse, the EU Settlement Scheme and arrangements connected with the UK’s participation in Erasmus+.
For Indian workers already in the UK, the key takeaway is that the new protection is specifically aimed at those who can establish that they have been victims of modern slavery or trafficking. Workers facing workplace problems should therefore distinguish between ordinary employment disputes and situations involving serious exploitation that meet the relevant legal threshold. The new rules provide a route for recognised victims to escape an abusive sponsor while retaining the ability to work legally for the remainder of their existing visa.
The policy marks a notable shift in the balance between immigration control and worker protection. By allowing recognised victims to move away from abusive sponsors without immediately putting their immigration status at risk, the UK government is seeking to ensure that migrant workers are not forced to remain in harmful employment simply because their right to stay is tied to their job.
